the outcome of that US court ruling could be quite interesting

also, surely it wouldnt be a problem for a bit torrent site that wasnt based in the US. (For the record, this site is based in Mexico..)

mac_daddy the us courts also killed the "anti-bootleg bill" (but i am too tired to go find the link for it right now - i am pretty sure it is linked somewhere in the ezt autopsy over at /.)

brianisnotdead First of all: A provider may not give clients names, addresses, or whatever. It's against the law. The provider in question didn't do this but they just send a fax.

Second: It surprises me that they are German lawyers. It's a wellknown fact that in Germany the laws of privacy matters are one of the strongest in Europe. What I mean is that they know they can't do much.

Third: Kazaa. Also P2P, has won his case before the court because downloading is allowed. Only the uploading is against the lay. So a site with torrent information can never be prosecuted. And everybody knows that catching the uploaders by P2P is impossible.

THIS is the whole question.

Its the topic at the moment in different courts, in
different countries.

And they just might well rule that a provider has to
give the details when their client commits and offence.
It's where it seems to going to here in france anyway...

Holand, so far, has ruled against it.

and locating the servers in acountry like this, where the laws protect the users might be the answer to alot of this...
