Nightclub Seeks Manslaughter Protection

PROVIDENCE, R.I. - The owners of a Rhode Island nightclub where 100 people died in a fire set off by a band's pyrotechnics are suing their insurer to force it to cover the costs of their criminal defense.

Jeffrey and Michael Derderian each face 200 charges of involuntary manslaughter, two for each of the victims in the Feb. 20, 2003, fire at The Station nightclub.

The Derderians claim Essex Insurance Co. must pay for their defense because if they are found guilty, under Rhode Island law, a civil judgment establishing their liability will automatically be entered against them.

The nightclub had $2 million in liability coverage from the company, The Providence Journal reported Tuesday's editions.

The fire started from pyrotechnics used during a performance by the band Great White. Dan Biechele, the band's former tour manager, is under indictment on the same charges as the Derderians.

In answering the lawsuit, Virginia-based Essex said it is not responsible for criminal charges and the Derderians "failed to exercise ordinary care for the security of their own position and their own well-being."
