The children of James Brown and his former partner have decided on where the soul singer should be buried nearly two months after he died, his lawyer confirmed on Tuesday (February 20).

"The children and the wife, my client Tomi Rae Brown, have come to an agreement and they have decided that he will be buried in a decent place but it's going to be kept confidential," said lawyer Robert Rosen.

The agreement comes during an ongoing legal battle over control of the singer’s assets and estate.

The case is particularly complicated as it still has to be established whether the funk legend's former partner Tomi Rae Hynie Brown was legally married to him. Tomi Rae received nothing when Brown's will was read in January but is suing for 50 percent of his estate, with a further cut to go to their child.

The judge in the case has appointed a special administrator to oversee the execution of the will and will probably grant and permission for DNA to be taken from Brown's body to determine a contested paternity case, Rosen said.

Brown wished to be buried at his Beech Island estate in South Carolina; however ownership of the property still remains in doubt.

"Assuming a court order is signed he could be buried in the next few days," Rosen said in an interview, adding that the burial would probably be private.
