A bus driver for the Dave Matthews Band was expected to be criminally charged today with dumping liquid human waste onto a Chicago River architectural tour boat last summer, a law enforcement source said.
The driver, of Corpus Christi, Texas, was expected to surrender to Chicago Police and be charged with reckless conduct and contaminating the Chicago River -- both misdemeanors, the source said.
The driver has cooperated with investigators, although he has not admitted to dumping the 800 pounds of waste that soaked passengers as the boat passed under the Kinzie Street bridge Aug. 8. Several complained the brownish-yellow waste hit their eyes, mouth and hair.
Cook County State's Attorney Dick Devine was expected to outline the case today at a news conference. The Chicago Sun-Times is not naming the driver because he had not been charged Tuesday.
WHY INVESTIGATION TOOK SO LONG
Investigators say they have videotape putting the bus and the driver on the bridge at the time of the dumping. The investigation was especially lengthy in part because the bus was traveling with the band and had to be returned to Chicago to be examined, the source said.
"It took a long time to interview witnesses and review documentation, including various videotapes," the source said.
The Dave Matthews Band has cooperated with investigators. Late last year it donated $100,000 to river restoration efforts.
The driver, who has been suspended from the band, is expected to get a date to appear in a municipal courtroom, the source said.
In November, Nancy Todor, a boat passenger, sued the band, claiming she and 108 others were hit with waste that made her "physically ill" and "extremely nauseous."
